引言1980年,我曾发表过一篇题为“认真对待事实”的论文,这篇文章广为人知但却几乎未能产生什么影响。我觉得,这篇文章的观点非但正确,而且对我们在法律方法、法律理论、证据法以及法学教育等方面的学术研究的理念和实践都非常重要。它的命运让我想起了卡尔·卢埃林的一句名言:“当西塞罗发表演说的时候,你说:‘没有一个德行之人能够如此雄辩’;而当德摩斯梯尼发表演说的时候,你却叫喊道:‘开战!!’”这篇文章似乎已成为一个失败的倡议。
Introduction In 1980, I published an essay titled “Taking Facts Seriously.” This article is widely known but barely has any effect. I think the article’s view is not only correct, but also very important to our philosophy and practice in academic research in legal methods, legal theory, evidence law and legal education. Its fate reminds me of Karl Llewellyn’s famous quote: “When Cicero gave a speech, you said: ’There is not a virtuous man who can speak so eloquently’, and when Demosthenes delivered his speech You shouted: ’A war !!’ ”This article seems to have become a failed initiative.
