建构行政首长问责制度,就是在规范行政首长权力配置的基础上,由问责主体过问其权力运用情况,并对其不当或违法运用权力情况进行追究。作为民主政治的基本要求,行政首长问责是宪政民主政体下有限政府和责任政府的一个重要实现途径,同时也是推进民主政治和实现社会公正的必然要求。本文试从行政首长问责制的概念界定出发,进而探讨行政首长问责制应遵循的原则问题。
The construction of the system of accountability for executive heads means that the main body of accountability should ask questions about the exercise of its powers and regularize its improper or illegal use of power on the basis of standardizing the allocation of power among executive heads. As the basic requirement of democratic politics, the accountability of executive heads is an important way to realize the limited and responsible government under the constitutional democracy. It is also an inevitable requirement for promoting democratic politics and realizing social justice. This article attempts to set out from the concept of the executive head of the accountability system, and then explore the principle of accountability should be followed by the executive head.
