对于应然价值追求和实然价值追求的混淆是我国当前大学章程难产的重要原因。在现行的制度环境下,我国难以实现西方意义上的、完全的大学自治,因此应当将“自治”作为应然的、终极的价值追求,而把法律规范和政策文件中明确承认的“自主”作为实然的、务实的价值追求,从而以应然和实然的二元划分的逻辑为起点构建具有中国特色的现代大学制度。
The confusion about the value pursuit and the actual value pursuit should be the important reasons for the current dilemma of college constitution in our country. Under the current system environment, it is difficult for our country to realize the complete autonomy of the university in the western sense.
