改革开放肯定了以个人利益为基础的激励制度。而国家公职人员的职业责任是实现公共利益最大化,于是国家公职人员在行使公共权力过程中必然会存在个人利益与公共利益的冲突。利益冲突贯穿于公共决策的全过程。当前我国处于集权权力结构向制约权力结构的变迁过程之中,既有的利益表达渠道容量不足,与现代市场经济相适应的决策规则和激励机制尚未建立,对公共决策中的利益冲突的防范与化解形成了严峻挑战。化解和防范利益冲突对公共决策的不当影响,需要增强公共决策的开放性,改革当前决策权力过于集中的体制,健全决策规则设计,完善决策激励机制,以此来限制与引导决策者的自利行为。

The national public servants’ professional responsibility is to maximize the public interest, so the public officials in the exercise of public power inevitably exist in the personal interests and the public interest in the conflict. Conflict of interest runs through the whole process of public decision-making. At present, China is in the process of changing the structure of the power of authoritarian power to the power structure of the restricted power. The existing channels of expression of interests are not enough. The decision-making rules and incentive mechanisms that are compatible with the modern market economy have not yet been established. Resolved to form a serious challenge. To resolve and prevent the improper influence of conflict of interest on public decision-making, it is necessary to enhance the openness of public decision-making, reform the current centralized system of decision-making power, perfect the design of decision-making rules and improve the decision-making incentive mechanism so as to limit and guide self- behavior.
