依法治国与以德治国相结合是指在法治框架下法律与道德信仰的结合,究其最后的归宿仍属法治。法律适域问题和法律自身的局限性为两者相结合提供了可能;而德治精神内涵和法治价值追求在尊重人、解放人问题上的同一性则使两者的结合成为必然。在中国改革进入攻坚期和深水期的关键时刻,重要法律体制的改革也呼之欲出,为两者结合提供了现实基础。
The combination of governing the country according to law and administering the country with virtue means the combination of law and moral beliefs within the framework of the rule of law and its final destination is still the rule of law. The issue of legal suitability and the limitation of law itself provide the possibility for the combination of the two. However, the combination of the moral connotation of the rule of virtue and the pursuit of the value of the rule of law in the respect of man and liberation issue makes the combination of the two inevitable. At a critical moment when China’s reform has entered a crucial period and a deep-water period, the reform of important legal systems is also expected to come out, providing a realistic basis for the combination of the two.
