香港金融消费者保护制度主要是由香港金融管理局负责促进银行体系稳定及有效运作的政府机构。虽然金管局没有保障消费者的法定责任,但根据《银行业条例》,金管局有责任确保银行以负责、诚实及务实的态度经营,以及促进银行维持正当操守标准及良好和稳妥的业务规则。金管局的职能也包括遏止与银行业务有关的非法或不正当的行为。但从雷曼迷你债事件后,也反映出香港在金融投资产品消费者保护方面存在的缺失。本文以金融投资产品为视角透视香港金融消费者保护制度的新发展。
The financial consumer protection system in Hong Kong is mainly composed of the government agencies that the Hong Kong Monetary Authority is responsible for promoting the stable and effective operation of the banking system. Although the HKMA does not guarantee consumers’ statutory responsibilities, under the Banking Ordinance, it is the HKMA’s responsibility to ensure that banks operate in a responsible, honest and pragmatic manner and to promote the maintenance of a fair standard of conduct and sound and sound business rules. The HKMA’s functions also include deterring illegal or improper conduct related to banking. However, after the Lehman mini-debt incident, it also reflects Hong Kong’s lack of consumer protection of financial investment products. This essay looks at the new development of the financial consumer protection system in Hong Kong from the perspective of financial investment products.
