文学作品在传统上被认为是一种对法律进行思考的有力途径,它的虚构叙述充分提供了法律困境的细节例证。从法律与文学的本质,分析法律与文学这一交叉学科的研究基础,回顾这一运动的国内外研究现状及研究分支,重点从文学中的法律这一进路出发,以美国近现代小说为例,分析“文学中的法律”研究方法与文学作品中表现的法律危机与法律批判。
Literary works have traditionally been viewed as a powerful way of thinking about the law, and its fictional narratives provide full details of the legal dilemma. From the nature of law and literature, this paper analyzes the research foundation of the interdisciplinary law and literature, reviews the research status and research branches of this movement at home and abroad, and focuses on the approach of law in literature. For example, analyze the “legal law in literature” research method and the legal crisis and legal criticism manifested in literary works.
