个案急呈:宁某是一所教育学院食堂的职工。2010年9月,他到该学院的食堂工作。该学院内部制度规定,所有职工都要按照规定缴纳各种社会保险,否则单位有权解除劳动合同。但宁某不愿意参加社会保险,该学院人事部门多次劝导,都未能说服宁某,于是教育学院解除了双方的劳动关系。宁某不服,随即向当地劳动争议仲裁委员会申请仲裁。
Case in an excuse: Ning is a staff of the education college canteen. In September 2010, he went to the college canteen. The internal system of the college provides that all employees must pay various social insurances in accordance with the regulations, otherwise the unit has the right to terminate the labor contract. However, Ning did not want to participate in social insurance, the Department of Personnel repeatedly advised, failed to convince Ning, so the Institute of Education lifted the labor relations between the two sides. Ning rather refuse to submit to the local labor dispute arbitration commission for arbitration.
