中央与地方存在着法律权力方面的冲突,而法律权力主要体现为立法权,这种冲突的根源是多方面的,包括法律的地域性差异、缺乏完善的行政组织法规和双方间的利益冲突。因此,解决两者之间的冲突需要有良好的组织结构和平衡的利益关系,引入分权制衡原则,这样才可能达到两者之间在制度和结构上的均衡状态。
The conflicts between the central government and the local government exist in legal power. The legal power is mainly embodied in the legislative power. The root causes of such conflicts are many, including the regional differences of laws, the lack of perfect administrative rules and regulations and the conflict of interests between the two parties. Therefore, resolving the conflicts between the two needs a good organizational structure and a balanced interest relationship, and the principle of checks and balances should be introduced so as to achieve a balanced institutional and structural balance between the two.
