我国农业生态环境法制建设日益受到社会重视并将逐步走向完善。但作为一种解决农业生态环境问题的农业生态补偿却未在我国法律制定及其法律实施中得到重视。我国农业生态补偿政策缺乏完善的法律保障,在立法层面上缺乏系统性和完整性。本文旨在探讨我国农业生态补偿立法的相关问题,在分析我国农业生态补偿立法缺陷的基础上,对我国农业生态补偿立法模式、立法进程及立法内容提出相应的设计建议。
The construction of legal system of agro-ecological environment in our country is paid more and more attention by the society and will gradually be improved. However, as a kind of agro-ecological compensation to solve the problem of agro-ecological environment, it has not been taken seriously in our country’s law making and its law enforcement. Our country agro-ecological compensation policy lacks the perfect legal guarantee, lacks systematism and the completeness in the legislation level. Based on the analysis of the legislative defects of China’s agro-ecological compensation, this article aims to probe into the relevant issues of agro-ecological compensation legislation in our country, and puts forward corresponding design suggestions on the legislation model, legislative process and legislative content of agro-ecological compensation in China.
