目前我国行政法对非物质文化遗产传承人的保护方式有很多,但是问题又比较突出,主要体现在,保护理念的落后,行政确认制度、行政奖励与行政帮助制度不够完善,行政救济制度不够健全。针对以上问题,本文提出要确立权利归属理念与生态整体论理念,完善行政确认、行政奖励与行政帮助制度,完善行政救济制度。
At present, there are many ways to protect the inheritors of intangible cultural heritage in China’s administrative law, but the problems are more prominent, mainly reflected in the backwardness of the protection concept, the system of administrative confirmation, the system of administrative rewards and administrative assistance, and the inadequate administrative relief system . In view of the above problems, this paper proposes to establish the idea of ownership of rights and the concept of ecological holism, improve the system of administrative confirmation, administrative rewards and administrative assistance, and improve the administrative relief system.
