阐述数字环境下技术、版权法与作品存在对立统一的紧密关系。技术的发展,一方面使作品的公共物品属性急剧增强,社会公众使用作品的成本急剧下降;另一方面,通过版权人对作品保护技术的应用,提高公众使用作品的成本,作品的私人物品属性得到一定回升。版权法正是通过对技术保护措施的法律确认及进一步的版权扩张,努力使数字环境下的作品不致于成为纯粹的公共物品,保证版权人的收益高于生产与传播成本,激励作品的创作与传播,促进社会知识增长与进步。指出数字环境下的版权立法必须以维持社会公众与版权人的利益平衡为基础,并贯彻技术中性原则。
