反思西部地区环境立法中存在的主要问题。针对一些原有的法律观念、法律原则,提出要以一种全新的适合保护全球生态环境需要的角度来重新加以探讨和运用。指出环境立法思想应以生态规律为全面指导,树立环境资源价值观,强调环境承载能力有限的规律等,认为西部民族地区环境立法的重点和应对策略应是科学制定地方环境立法规划,利用地方自治优势,加快地方环境资源立法速度,完善地方立法体系和法律约束机制,在立法中突出以防为主的法律原则,建议赋予乡一级政府组织环境保护职能等。
Reflection on the Main Problems in Environmental Legislation in Western China. Aiming at some original legal concepts and legal principles, we propose to re-explore and apply them in a new perspective that is suitable for the protection of the global ecological environment. It points out that the environmental legislation should take the ecological law as the overall guidance, establish the values of environmental resources and emphasize the law of limited environmental carrying capacity. It is believed that the focus of the environmental legislation in western ethnic minority areas and the countermeasures should be to scientifically formulate the local environmental legislation plan and make use of the advantages of local autonomy , Speed up the legislative speed of local environmental resources, improve the local legislative system and legal restraint mechanism, highlight the legal principle of prevention in legislation, and give recommendations to the township government to organize environmental protection functions.
