能源法的法哲学研究目前在我国极不发达,已成为影响我国能源法学深入发展的瓶颈。能源自身的物质特性和人们对其哲学认知,以及人们对于能源所持的态度即能源伦理,还有能源规律构成了能源法的法哲学基础。能源的有限性、分布不均和污染性等特性,是其节制、安全、清洁等价值存在的基础;对能源本质、意义及价值所在的哲学认知,有助于充分深化人们对能源法问题的认知;围绕能源与人、能源法与人所展开的探讨,构成能源法法哲学的人性基础和伦理之维;能源自身以及能源生态、能源经济等规律,更是能源法法哲学研究不可缺的科学基础。我国能源法研究的迫切任务之一就是深入地进行能源法的哲学研究,将能源法学研究推进到法哲学的高度,唯此我国能源法学研究才有坚实的理论基础。

The philosophical understanding of the nature, significance and value of energy contributes to fully deepening the awareness of energy law Of the cognitive; around the energy and people, energy law and human exploration, constitute the human nature of energy law philosophy and ethics dimension; energy itself and energy ecology, energy economy and other laws, but also energy law and philosophy can not The lack of scientific basis. One of the urgent tasks for the study of energy law in our country is to conduct in-depth philosophical study of energy law and promote the study of energy law to the level of jurisprudence. Only in this way can we have a solid theoretical foundation for the study of energy law in our country.
