党的十八届四中全会将法治作为一项治国理政的基本方式,为全面深化改革、建设法治中国提供了可行依据。相对于国家层面的法治建设而言,地方法治建设是一种地方治理法治化的过程和状态,也是法治中国的进一步细化和延伸。江西作为第三批司法体制改革试点省份,已逐步开展司法人员分类管理、司法责任制、司法人员职业保障、省以下地方法院检察院人财物统一管理等试点工作。基于对试点进展和试点工作的分析,提出通过司法改革推进地方法治建设的设想和建议,从而顺利实现地方法治建设的目标。
The Fourth Plenary Session of the 18th Central Committee of the Party adopted the rule of law as a basic mode of governing the country and providing a feasible basis for deepening the reform in an all-round way and building a legalized China. Compared with the construction of the rule of law at the national level, the construction of the local rule of law is a process and state of local governance under the rule of law and a further refinement and extension of the rule of law in China. Jiangxi Province, as the third pilot province in the reform of the judicial system, has gradually carried out pilot projects such as the classification administration of judicial personnel, the judicial responsibility system, the occupational protection of judicial personnel and the unified management of property and procuratorate personnel under the provincial courts. Based on the analysis of the pilot progress and pilot projects, the author puts forward the ideas and suggestions of promoting the development of local law by judicial reform so as to achieve the goal of local legal construction smoothly.
