在我国建设社会主义市场经济体制的今天,研究我国的商法体系具有十分重要的意义。近些年我国学者就如何构建我国市场经济条件下的商法体系问题,展开了热烈的讨论,提出了很多建设性的意见。我们认为,为了建立这样的商法体系,我们应该着重研究如下问题:第一,要研究我国社会主义市场经济的社会基础和内在发展规律,为我国商法体系的建立确立深厚的哲学和经济学基础。第二,要研究我国面临的国际环境,顺应我国加入WTO和融入国际经济大潮的形势,建立与国际接轨的商法体系。第三,要在总结改革开放20多年商法建设的宝贵经验,对我国商法的现状进行深刻检讨的基础上,确立商法的基本原则和商法的立法模式,要对未来的商法进行科学的规划。
Today, in our country building a socialist market economic system, it is of great significance to study the system of commercial law in our country. In recent years, scholars in our country have held heated discussions on how to construct a commercial law system under the conditions of our market economy and put forward many constructive suggestions. In our opinion, in order to establish such a commercial law system, we should focus on the following issues: First, we must study the social basis and the inherent law of development of our socialist market economy and establish a profound philosophy and economic foundation for the establishment of our commercial law system. Second, we must study the international environment our country is facing, conform to the situation of China's accession to the WTO and its integration into the international economic tide, and establish a commercial law system that is in line with international standards. Thirdly, on the basis of summing up the precious experience of commercial law construction over 20 years of reform and opening up and reviewing the current situation of commercial law in our country, we should establish the basic principle of commercial law and the legislative mode of commercial law and make scientific planning for the future commercial law.
