一、企业法律形态企业法律形态是企业法或商法所确定的企业组织的存在形式。企业法律形态经历了长期的历史发展,早已形成了通行于世界各国的传统类型:独资企业、合伙企业和公司企业三大类。它们各自具有不同的特点和优势。(一)独资企业。这是指由一人出资组成并由其一人拥有的企业。其突出特点是企业本身不具有法人地位,没有独立人格。企业的财产归独资企业主所有,经营管理权由企业主独立享有,企业的经营利益和风险亦由企业主个人承受,其中包括企业主以其个人财产对独资企业的债务承担无限责任。
