全球性的新一轮经济性裁员频率越来越高,裁减规模亦越来越大,我国亦紧随经济性裁员浪潮的步伐。2016年乐视公司裁员将近千人,裁员规模占总人数的百分之十。新兴的手机生产商魅族公司实行经济性裁员也达到总员工的百分之五。我国一方面坚持市场经济体制下的企业自由经营,一方面对劳动者的就业进行必要的保障。笔者从我国经济性裁员法律制度出发,阐述该制度在法律适用中存在的标准过于模糊、连续性经济裁员规范的缺失等诸多问题,重点论述企业、劳动者、政府之间的角色定位问题,提供经济性裁员的制度性建议,以期更好地保障企业的自主经营权、劳动者的劳动权。
