改革开放以来,虽然我国特殊教育事业取得了一定成绩,但特殊教育立法方面依然存在一些问题,如法律体系不完备,结构层次不完整;整体上立法规格较低,法律效力不足;特殊教育法律相对笼统,可操作性低;立法科学性低,立法人员思想观念和专业素质弱。针对以上存在的问题提出完善特殊教育立法体系,注意立法质量,提高特殊教育法的层次;倡议建立相关立法监督机关,以保障法律的实施效力;增强立法的可操作性;加强立法人员特教素养等建议。
