美国的禁止令种类比我国多,且禁止令与刑罚之间的界限模糊。美国的禁止令有强制适用和酌定适用两种适用方式,强制禁止令适用范围比我国广,酌定禁止令有不同的优先级别。在美国,违反了禁止令并不必然导致收监执行。如果法官决定撤销禁止令,应当举行听证程序。美国禁止令在执行过程中有专业化的执行机构和执行队伍作为保障,并且有先进的科学技术作为支撑。我国可以吸收美国禁止令制度中的合理成分,逐步扩大禁止令的适用范围,设立撤销禁止令的听证程序,加强执行机关的人员保障,吸收社会参与禁止令的执行,加大禁止令执行中的科技投入。
