土地行政行为和使用行为的合法性与合理性——基于基层土地管理的实践探讨

在基层土地管理实践中,经常会面临这样的困惑:一些看似合理的用地,在执法者看来并不合法,而一些合乎法律规定的用地,在人们情感上又难以接受或不合理。最近,在查对某宗土地行政诉讼案件具体行政行为是否合法合理资料,并参阅《最新国土资源依法行政全书》、《新土地管理法与土地管理实务全书》等相关工具用书时,几乎找不到土地合法性与合理性内涵、关系、表现、对策等相关论述。如何达到既合法又合理的理想用地、管地状态,这是全国土地房地产管理工作者必须认真研究的重大课题。 At the grassroots level, land management practices often face the confusion that some seemingly reasonable land does not appear legitimate to law enforcement officials, while some land that is legally prescribed is emotionally unacceptable or unreasonable to people.
