随着互联网技术的迅猛发展和广泛应用,与网络有关的新鲜事物层出不穷,其中之一的就是网络虚拟财产。由网络虚拟财产引发的纠纷在逐渐增加,因我国现行法律还没有明确网络虚拟财产的法律定位,这就给我国司法实务界带来了诸多困扰和难题,引起了理论界的普遍争议。尽管如此,网络虚拟财产作为一种新兴的财产形态逐渐被越来越多的人所认可。本文简要介绍了网络虚拟财产的定义及特征,特别针对网络虚拟财产在实施法律保护中遇到的争议加以分析和探讨,希望对网络虚拟财产的法律研究及相关立法起到参考作用。
With the rapid development and widespread application of Internet technology, there are an endless stream of new things related to the Internet. One of them is network virtual property. The disputes caused by the network virtual property are gradually increasing. Because the current law of our country has not defined the legal position of the network virtual property, this has brought many troubles and problems for the judicial practice community in our country, arousing widespread controversy in the theoretical circle. However, online virtual property as a new form of property is gradually recognized by more and more people. This article briefly introduces the definition and characteristics of network virtual property, especially for the analysis and discussion of the disputes that the network virtual property encounters in the implementation of legal protection, hoping to have a reference role in the law research and related legislation of network virtual property.
