枪支管理工作作为公安机关治安行政管理工作的重要组成部分,在保卫国家安全、维护社会稳定、保障公民生产生活和娱乐需求等方面发挥着重要的作用。目前枪支管理在立法方面仍然存在较严重的行政管理痕迹,突出地表现为在立法上强化公务用枪管理、弱化民用枪支管理;强调行政权的优越性,忽视个人权利保障;同时还存在枪支概念不完善、枪支分类不科学、规范枪支使用的法律缺失等问题。因此,要加强枪支管理,从枪支管理立法上加以完善,具有重要的现实意义。
As an important part of public security organ administration of public security, the management of firearms plays an important role in safeguarding national security, maintaining social stability, ensuring citizens’ production, living and entertainment needs. At present, there are still some serious administrative management marks in the legislation on firearms management, which are prominently manifested in strengthening the administration of official use of firearms in legislation, weakening the management of civilian firearms, emphasizing the superiority of administrative power and neglecting the protection of individual rights. At the same time, there exists the concept of firearms Imperfect, unscientific classification of firearms, the lack of laws regulating the use of firearms and other issues. Therefore, it is of great practical significance to strengthen the management of firearms and improve its legislation on firearms management.
