非物质文化遗产,是各民族世代相传并视为其文化遗产组成部分的各种传统文化表现形式,以及与传统文化表现形式相关的实物和场所,是一定民族或群体历史创作和积累的宝贵文化资源。在现代化多元型文化和生产生活方式的冲击下,非物质文化遗产呈现出萎缩的局面。在2011年张艺谋与安顺地戏正名的“纠缠”中,非物质文化遗产的保护模式选择再次成为争议和讨论的焦点。本文就非物质文化遗产的知识产权保护模式及相关路径的扩展尝试进行初步探索和分析,旨在能够为非物质文化遗产的保护体系构建提出一些可供借鉴的意见。
The intangible cultural heritage is a variety of traditional cultural expressions that are transmitted from generation to generation and considered as part of their cultural heritage as well as the physical objects and places associated with traditional cultural expressions. They are valuable cultural creations and accumulations of certain national or group history Resources. Under the impact of modern diversified cultures and productive lifestyles, the intangible cultural heritage has shown a shrinking situation. In 2011, when Zhang Yimou and Anshun were just playing host to the “entanglements,” the choice of the mode of protection of intangible cultural heritage once again became the focus of controversy and discussion. This paper attempts to explore and analyze the mode of intellectual property protection of intangible cultural heritage and the extension of relevant path in order to provide some suggestions for the construction of the protection system of intangible cultural heritage.
