罗森贝克将实体法规范分成三类:权利产生规范,权利妨碍规范和权利消灭规范。权利产生规范是使权利或者法律关系产生的规范,由主张权利或者法律关系产生的一方当事人举证证明;权利妨碍规范则是阻碍权利或者法律关系产生的规范,权利消灭规范是指使权利或法律关系消灭的规范,由主张妨碍、消灭权利的一方当事人即主张权利产生的相对方来举证证明。
Rosenberk divides the substantive law into three categories: the right to produce norms, the right to prevent norms and the right to eliminate norms. The norm of right creation is the norm of making the right or the legal relationship produced by one of the parties who advocate the right or the legal relationship. The obstruction of the norm is the norm which hinder the right or the legal relationship. The norm of eliminating the right refers to the elimination of the right or the legal relation By the advocate obstruction, eradication of rights of the parties that advocate the emergence of the right to prove the evidence.
