美国最高法院通过了关于专家证言的新规定。法院认为审判的法官不应该颠倒专家的结论,除非他们的结论明显错误。最高法院的规定旨在赋予法官筛选出那些因为没有遵循科学的方法而必然不可靠的所谓科学证据。 Breyer法官指出,对于不是科学家和没有受过科学训练的法官来说,作出一个对专家学者提供的科学方法以及相关的结论的精细复杂的判断是非常困难的。特别是在科学本身还处于试验性或不确定的领域中发生的案件。
The U.S. Supreme Court passed a new rule on expert testimony. The court held that the judge at trial should not reverse the expert’s conclusion unless their conclusion is clearly wrong. The Supreme Court’s rules are intended to give judges the chance to screen what they call scientific evidence that must not be unreliable because they did not follow the scientific method. Judge Breyer pointed out that it is very difficult for a judge, who is neither a scientist nor a trained scientist, to make a sophisticated judgment on the scientific methods and related conclusions provided by experts and scholars. Especially in cases where science itself is still in a tentative or uncertain field.
