从最实质的方面看,侦查并不是一个简单的遵守法律规范的行为,而是侦查员与刑事案件相互作用的一个过程。由于这一过程具有非常动态的特性,因而要对侦查这门技艺进行传递是很困难的。我们可能有这样的体会,知道如何对待每一起具体的刑事案件,但是要把的这种经验和思想方法从归类的范畴表达出来,并不是件容易的事情。当然,这并不是说就难以表达我们对侦查的认识。事实上,我们已经注意到,作案人的意识和行为过程可能是所有侦查中最基本的要素,我们期望通过阐述这些要素来建立规范的侦查思路,摆脱那种思想和行为的盲目。当然,这仅仅是探索。
In its most essential aspect, investigation is not a simple act of obeying norms but a process of interaction between investigators and criminal cases. Due to the very dynamic nature of this process, it is difficult to pass on the technique of detection. We may have the experience of knowing how to treat every specific criminal case, but it is not easy to express this category of experience and method of thinking from the categorized perspective. Of course, this does not mean that it is difficult to express our understanding of the investigation. In fact, we have noticed that the process of the perpetrator’s awareness and conduct may be the most basic element of all investigations. We hope that these elements can be used to establish a normative investigation and to get rid of the blindness of those thoughts and behaviors. Of course, this is just exploration.
