国际互联网的迅猛发展给传统的知识产权体系带来了巨大冲击,知识产权客体的特殊性使得与知识产权有关的法律问题在网络环境下表现得格外突出。本文主要结合我国目前网络环境下知识产权领域出现的侵权问题,分析知识产权保护遇到的主要难题,针对网络知识产权侵权的内在规律和特点,提出构建法律、技术和道德“三位一体”的对策,实现对网络知识产权的有效保护。
The rapid development of the Internet has brought a huge impact on the traditional intellectual property system. The particularity of the object of intellectual property makes the legal issues related to intellectual property appear particularly prominent under the network environment. This paper mainly analyzes the main problems of IPR protection in connection with the current infringement problems in the field of IPR in the network environment of our country. In view of the inherent laws and characteristics of infringement of IPR, this paper proposes that the construction of law, technology and morality should be “Trinity” Countermeasures, to achieve effective protection of the network of intellectual property.
