1 业主委员会的性质 1997年7月1日施行的《上海市居住物业管理条例》,对业主委员会性质的表述是:“物业管理区域内代表全体业主对物业实施自治管理的组织。”作为“自治管理”组织的业主委员会,自治管理什么?哪些人可当选为业委会的委员?笔者试作如下探讨。 1.1 自治管理的内容 业委会的“自治管理”应包含两个方面的内容:物(物业)和人(业主与非业主使用人)。根据我国目前物业管理的情况,业委会对物业的管理条件还远不成熟。这是因为:首先物业管理需要有一定的专业技术和技术力量;其次要有相应的法规或法律作保
