奥运特许经营本质上是一种以知识产权授权为核心、以契约规则为依据的商业化行为,奥运特许经营授权关系所指向的对象是与奥运会有关的知识产权,特许人基于对奥运会知识产权的控制,实现对被特许人的市场准入;奥运知识产权保护始终是贯穿所有奥运特许规则的一条逻辑主线,知识产权授权是奥运特许经营的核心,而特许契约规则是奥运特许经营的法律依据;明晰奥运特许经营的授权逻辑与特许规则的本质,对于规范和开发我国体育赛事市场、促进体育消费、助推创意经济,具有重要的现实意义。
