为了促进香港、澳门与内地建立更紧密经贸关系,鼓励香港服务提供者和澳门服务提供者在内地设立从事旅游和与旅游相关的服务的企业,根据国务院批准的《〈内地与香港关于建立更紧密经贸关系的安排〉补充协议二》及《〈内地与澳门关于建立更紧密经贸关系的安排〉补充协议二》,现就《设立外商控股、外商独资旅行社暂行规定》(国家旅游局、商务部令[2003]第19号)做出如下补充规定:一、降低香港服务提供者和澳门服务提供者进入内地的准入条件,即:在内地设立独资旅行社的香港服务提供者和澳门服务提供者的年旅游经营总额不低于2500万美元,在内地设立合资旅行社的香港服务提供者和澳门服务提供者的年旅游经营总额不低于1200万美元。二、本规定中的香港服务提供者和澳门服务提供者应分别符合《内地与香港关于建立更紧密经贸关系的安排》及《内地与澳门关于建立更紧密经贸关系的安排》中关于“服务提供者”定义及相关规定的要求。三、香港服务提供者和澳门服务提供者在内地投资旅行社的其他规定,仍按照《设立外商控股、外商独资旅行社暂行规定》执行。四、本规定由国家旅游局和商务部共同负责解释。五、本规定自2006年1月1日起实施。
In order to promote the establishment of closer economic and trade ties between Hong Kong and Macao and the Mainland and to encourage Hong Kong service suppliers and MSPs to set up tourism-related and tourism-related services in the Mainland, according to the State Council’s approval, “The Mainland and Hong Kong Closer Economic Partnership Arrangement Supplement II to the Supplement II to the Agreement on Economic and Trade Relations and Supplement II to the Mainland and Macao Closer Economic Partnership Arrangement (CITES) are hereby promulgated on the Provisional Regulations on the Establishment of Foreign-Funded and Wholly Foreign Owned Travel Agencies (CNTA, MOFCOM Decree [2003] No. 19) provides the following supplementary provisions: First, to reduce the access conditions for Hong Kong service suppliers and Macao service suppliers to enter the Mainland, namely: setting up a Hong Kong service provider and a Macao service provider of a wholly-owned travel agency in the Mainland The total annual tourism operation is no less than 25 million U.S. dollars. Hong Kong service providers and service providers that set up joint venture travel agencies in the Mainland shall have a total annual tourism operation of not less than 12 million U.S. dollars. 2. The Hong Kong service suppliers and the Macao service suppliers in these Provisions shall comply with the provisions in the ”Mainland and Hong Kong Closer Economic Partnership Arrangement“ and the ”Mainland and Macao Closer Economic Partnership Arrangement“ Provider ”definition and related requirements. Third, other provisions for Hong Kong service suppliers and Macao service suppliers to invest in travel agencies in the Mainland are still implemented in accordance with the Provisional Regulations on Establishing Foreign-controlled and Wholly Foreign-owned Travel Agencies.
