在新的宪政体制下,香港特区的司法权独立于中央国家的司法权,与内地的法院系统不存在任何组织或权力关系。内地和香港都独立地行使着各自的司法权力,为维护国家整体的制度秩序,权力之间的衔接难免会出现问题,如某一方不履行应尽的义务、不适当地扩大了自身的权力、双方意见存在分歧等。这些问题产生的原因包括两地间不同的法律制度、法律观念产生的分歧,制度设计的不足以及经济政治因素的掺杂,而最根本的原因在于在基本法设计时,中央放弃了对香港的司法管治权。笔者通过分析这些问题产生的原因,希望能提出一些对实践有所裨益的建议。
Under the new constitutional system, the judicial power of the HKSAR is independent of the jurisdiction of the central state and does not have any organizational or power relationship with the court system in the Mainland. Both the Mainland and Hong Kong independently exercise their respective judicial powers. In order to safeguard the overall institutional order of the country, there will inevitably be problems with the cohesion between powers. For example, if one party fails to fulfill its due obligations and improperly expands its own power, both parties Disagreements exist. The root causes of these problems include the differences in legal systems between the two places, the divergence of legal concepts, the inadequacies of system design and the doping of economic and political factors. The most fundamental reason is that the Central Government gave up its judiciary over Hong Kong in the design of the Basic Law Governance power. The author analyzes the causes of these problems, hoping to put forward some suggestions for the practice of some benefit.
