新闻自由权是人的基本权利之一。随着社会发展,新闻媒体角色发生了变化,由在政治事务上单纯的立场中立的旁观者,变成了现代政治事务中重要的参与者,这种变化更要求保障新闻媒体的新闻自由。而政治文明是人类改造社会的进步政治成果的总和,新闻自由法治化作为政治文明的重要组成部分,是衡量一个国家政治文明程度的重要标志。因此在当代中国社会转型背景下,将其法治化研究纳入政治文明视域,对于我们更好地利用新闻自由法治及其规范化的新闻自由活动调节政治关系,最终推动国家政治文明具有重要意义。本文试图基于以赛亚·伯林的两种自由概念,在政治文明视域下为新闻自由法治化建设提供些依据及路径取向。
The right to freedom of the press is one of the basic human rights. With the development of society, the role of the news media has changed. It has become an important participant in modern political affairs from a purely neutral observer in political affairs. Such a change also requires safeguarding the freedom of press in the news media. The political civilization is the sum of progressive political achievements of human transformation of society. As an important part of political civilization, the legalization of freedom of the press is an important symbol to measure the degree of political civilization of a country. Therefore, under the background of the contemporary Chinese social transformation, integrating the study of the rule of law into the political civilization is of great significance for us to make better use of the press freedom and rule of law and its standardized press freedom activities to regulate political relations and ultimately promote the political civilization of the country. This article attempts to provide some basis and path orientation for the legalization of press freedom under the vision of political civilization based on two free concepts of Isaiah Berlin.
