美国“The Beach Boys”乐队的成员Jardine在乐队解散以后组建了自己的乐队,进行乐队宣传时提及自己是“The Beach Boys”的原成员。使用了包含“The Beach Boys”的用语作为自己的乐团名称,因而与“The Beach Boys”的商标所有权人Brother Records.Inc.(以下简称“BRI”)发生了冲突。BRI认为Jardine的这种宣传方式侵犯了自己的商标专用权,Jardine则提出自己的使用应该属于“商标合理使用”的范畴。美国联邦最高法院对此案的司法判决纠正了地区法院和上诉法院对于“商标合理使用”的认定,使“商标合理使用”制度在美国得到了进一步的发展。
Jardine, a member of the United States “The Beach Boys” band, formed his own band after the band was dissolved and referred to himself as the original member of “The Beach Boys” during the band’s promotion. Used the term “The Beach Boys” as their own orchestra name and therefore clashed with Brother Records Inc. (“BRI”), the trademark owner of “The Beach Boys.” BRI believes Jardine’s propaganda infringes its own trademark rights and Jardine suggests that its use should fall within the category of “fair use of the trademark.” Judicial judgments of the U.S. Supreme Court in this case have corrected the recognition of “fair use of trademark ” by the District Court and the Court of Appeal, so that the “fair use of trademark ” system has been further developed in the United States.
