《中华人民共和国村民委员会组织法》(以下简称《村委会组织法》)中通过选民登记制度对于本村哪些人拥有选举权的规定详细而明确,但《中华人民共和国城市居民委员会组织法》(以下简称《居委会组织法》)并没有规定该项制度,而是见于各省民政部门颁布的“办法”或“指导规程”。选举权是宪法赋予公民的一项基本权利,是居民享有各项自治权、保障城市基层民主顺利实施的重要前提。文章认为随着城市化的发展以及户籍制度的改革,这一问题应引起我们足够的重视。
The Constitution of the People’s Republic of China on Villagers ’Committees (hereinafter referred to as the Organic Law of the Villagers’ Committees) provides a detailed and clear definition of who owns the right to vote in the village through the voter registration system. However, the Organic Law of the Urban Residents of the People’s Republic of China Referred to as “neighborhood organization law”) does not provide for the system, but found in the civil affairs departments of various provinces promulgated “measures ” or “guiding principles ”. The right to vote is a basic right conferred on the citizens by the Constitution and an important prerequisite for residents to enjoy their autonomy and guarantee the smooth implementation of urban grassroots democracy. The article believes that with the development of urbanization and the reform of the household registration system, this issue should arouse enough attention from us.
