明确土地发展权的性质使得优化配置土地资源功能得到充分发挥,并且可以更好地保护土地发展权主体的权益。在此背景下首先通过土地使用权性质的改变和土地利用程度两个方面去界定土地发展权的概念,接着对目前关于土地发展权法律性质的学说:私权说、公权说、公私双重属性说进行理论分析,层层递进,完整地揭示了土地发展权的法律性质,即土地发展权是一种新型的用益物权,是对传统物权体系的充实和发展,有利于解决外部性问题和实现可持续发展之目的。
