国际条约的临时适用是一项重要而特殊的条约机制,它是指条约签署国在条约生效前根据条约的规定或全体签署国之间其他形式的合意,将条约的全部或部分条款适用于与该条约相关的行为、事实和情况。《维也纳条约法公约》对临时适用规定较为简略,其亦未得到学界的足够关注。临时适用已经具有丰富的条约实践,通过对其进行梳理,对进一步理解国际条约的临时适用具有重要意义。
The provisional application of an international treaty is an important and special treaty mechanism. It refers to the signatory states that, prior to the entry into force of a treaty, according to the provisions of the treaty or any other form of agreement between the signatories to the treaty, all or part of the treaty should be applied to the treaty with the Treaties related to the facts, facts and circumstances. The Vienna Convention on the Law of Treaties has a relatively simpler provision on provisional application and it has not received sufficient attention from the academic circles. Provisional application is already rich in treaty practice, through its combing, to further understand the provisional application of international treaties is of great significance.
