江苏省兴化市农技开发公司4月27日与兴化市货运公司签订一份水运300吨大米的运输合同,合同中虽然写明起点站兴化,到达港深圳蛇口,运到日期5月20日卸货日期三天等条款并约定卸货之前要预报托运人等,但未提供收贷人单位地址,只写了个电话号码。由于兴化货运公司是内河航运不能航海,所以它于4月29日又与南通海上公司签订了将300吨米运往蛇口的合同。合同是在电话上口头订的,只约定双方船5月5日在南通交货转装和收货人的电话号码,对农技开发公司要求卸货时提前预报只字未提。南通海上公司货轮5月18日抵达蛇口赤湾港后,按电话号码与收款人联系。由于深圳市正在更换电话号码,终未能取得联系,在找不到收货人的情况下,海上公司货轮5月20日将米卸了
