新浪网和徐静蕾就其博客广告收益而发生的纠纷,至今坊间仍议论纷纷。本文以契约法律人的视角回答了这一问题。通过“历史方法”、“合同解释”、“法律解释”等一系列法学方法的使用,本文认为:广告发布合同应当在新浪网和广告经营商之间订立,但该合同的订立须经徐静蕾的书面同意,同意的性质可视为其“形象权”的许可,徐静蕾应获得相应酬金。
Sina and Xu Jinglei on the blog advertising revenue disputes that have so far still talked about. This article answers the question with the perspective of contract lawyers. Through the use of a series of jurisprudence methods such as “Historical Methods ”, “Contract Interpretation ” and “Legal Interpretation ”, this article argues that the advertisement release contract should be concluded between Sina.com and the advertisement operator, Xu Jinglei shall be subject to the written consent of Xu Jinglei, the nature of the consent can be regarded as “image rights ” permission, Xu Jinglei should receive the corresponding remuneration.
