一、我国最低工资的设立及其原因我国最低工资制度是从1993年由劳动部以行政规章的形式制定《企业最低工资规定》。1994年7月八届国人大常委会审议通过《中华人民共和国劳动法》中,以国家立法的形式确立了我国最低工资保障制度。2004年3月1日颁布并实施了《最低工资规定》,至此后,各地都依据《规定》制定或调整了新的最低工资标准。最低工资规定,只要劳动者提供了单位时间的正常劳动,用人单位支付的劳动报酬不得低于政府规定的标准。
First, the establishment of China's minimum wage and its reasons China's minimum wage system was formulated in 1993 by the Ministry of Labor in the form of administrative regulations “minimum wage regulations.” In July 1994, the Standing Committee of the Eighth National People's Congress examined and adopted Labor Law of the People's Republic of China and established the minimum wage guarantee system in the form of national legislation. On March 1, 2004, the “Minimum Wage Regulations” were promulgated and implemented. Since then, new minimum wage standards have been formulated or adjusted by all localities according to the “Provisions”. The minimum wage stipulates that the remuneration paid by the employer shall not be lower than the government-prescribed standard as long as the worker provides normal labor per unit of time.
