《韓非子》的法哲學思想,不論統治之術或處世之道都直指法理學或法哲學的“規範”概念,而規範概念主要涉及人類的行爲或活動的規準,是一種價值概念。《韓非子》的價值體系同樣也構成通識教育中“理智德性”的養成與訓練。我們在日常生活中無可避免地習慣於以這些理智德性作爲處事的準則。就《韓非子》文本的法哲學思想反思,規範概念的價值體系是否也存有引領現代中國人思維、語言與行動的理智德性?本文試圖在當代語境下,藉由中西方哲學的比較,重新開采《韓非子》文本中相應於西方法哲學的理論詮釋,以達正確認識與評價法家學說的目的。
“Han Feizi” philosophy of law philosophy, regardless of the rule of art or the way of life are directed at the “normative” concept of jurisprudence or jurisprudence, normative concepts are mainly related to the standards of human behavior or activity, is a concept of value. The value system of “Han Feizi” also forms the cultivation and training of “virtue of virtue ” in general education. We are unavoidably accustomed in our daily life to these ethical principles as the standard of doing things. Reflections on the legal philosophy of “Han Fei-zi” texts and the normative system of values also contain the intellectual virtues leading the thinking, language and actions of modern Chinese people? This paper tries to compare the Chinese and Western philosophies in contemporary contexts , Re-mining “Han Fei-zi” in the text corresponding to the western legal philosophy of theoretical interpretation, so as to achieve a correct understanding and evaluation of the purpose of legal theory.
