民以食为天,当今社会关注的热点一再表现为频频发生的食品安全事件。法律作为规范食品安全最有效的手段,却未能从根本上解决我国现阶段的食品安全问题。本文以西藏地区食品安全的重要性和特殊性为起点,分析出目前西藏地区食品安全存在立法缺漏;执法和监督有效性差;食品召回制度未落实到位;事后补救措施不力;法律责任体系不完善等的不足,并从完善食品安全的法律法规;完善对食品安全监管部门的行政问责制度;在食品安全领域加强商业保险的介入;完善食品安全监管的法律责任体系等角度探寻解决问题的方法和路径。
Food is the world, the hot spots of concern in society have repeatedly manifested as frequent food safety incidents. As the most effective means of regulating food safety, the law has failed to fundamentally solve the current problem of food safety in our country. Based on the importance and particularity of food safety in Tibet, this article analyzes the current lack of legislation in food safety in Tibet, the poor effectiveness of law enforcement and supervision, the failure of the food recall system to be put in place, the weak remedial measures afterwards, the imperfect legal liability system, etc. And from the improvement of laws and regulations on food safety; perfecting the system of administrative accountability for food safety regulatory authorities; strengthening the involvement of commercial insurance in the field of food safety; improving the legal liability system for food safety supervision and other aspects to find solutions to the problems and path.
