立法质量评估和实效评估是立法评估制度的两个主要内容。目前我国各地立法评估普遍存在制度界分不清、自我评估居多以及实效评估被忽略等问题。我国的立法评估制度应从侧重“立法质量”向侧重“法律实效”的过程转变。深圳经济特区应当利用市场化、法治化和国际化的地区优势,契合法律实效评估的效益性、客观性和专业性需求,率先完成转变,为我国立法评估的功能转型提供先例。
Legislative assessment of the quality and effectiveness assessment of the legislative evaluation system are the two main elements. At present, there are many problems in the legislation assessment in our country, such as the unclear system, the large amount of self-assessment and the neglect of effectiveness evaluation. The legislative evaluation system of our country should shift from focusing on “quality of legislation” to focusing on “legal effectiveness”. Shenzhen Special Economic Zone should make use of the advantages of marketization, rule of law and internationalization to meet the needs of efficiency, objectivity and professionalism of legal effectiveness assessment and take the lead in completing the change so as to provide a precedent for the functional transformation of China’s legislative evaluation.
