《中华人民共和国食品安全法》(以下简称《食品安全法》)已经代替了《中华人民共和国食品卫生法》(以下简称《食品卫生法》),很多人在执法过程中发现,与《食品卫生法》相比,《食品安全法》将菌落总数和大肠菌群超标的食品在禁止生产经营的食品之外。对此,笔者认为只要改变《食品卫生法》时代对这一违法行为的处罚模式就可以处罚了(包括无生产日期或批号的即食食品)。同时该文对菌落总数和大肠菌群超标食品与“危害人体健康的物质”进了实质意义的区别。
