我国现行机动车法律基本上还处在行政法规的地位,尤其是机动车安全法至今没有提到立法的议程上。为减少交通事故、降低污染、合理使用能源,必须建立健全机动车法律体系,该法律体系是切实落实《汽车工业产业政策》的需要,也是使汽车工业成为我国支柱产业、迎接复关的需要。我国已基本具备了建立完善和执行机动车法律体系的基本条件,该法律体系应包括3方面的法律,即机动车构造方面的法律;有关驾驶员、行人等方面的法律;有关公路设施建造等方面的法律。
