法的精神在法的理论和实践过程中,倡导一种动态的精神追求;在法律的功能上,更多地侧重于在事情和事中对经济主体进行价值指引,它平等公正地对待各法律主体的利益,从各法律主体的利益结合点出发,努力促进各法律主体通过价值指引的方式来消弭冲突和对立,进而实现社会整体利益的增加。本文以经济法为例,从法的概念这一新角度出发探讨法的精神。
