改革开放以来,中国大地上兴起了蔚为壮观的民工潮。农民工问题成了社会各界关注和研究的热点之一。将农民工纳入社会保障立法体系已迫在眉睫,但目前对农民工社会保障立法模式的选择存在分歧。对此问题,主张应以“以人为本”和社会本位理念为指导,考虑农民工的现实情况,进行分类分层的立法模式设计。 Since the reform and opening up, a magnificent wave of migrant workers has emerged in the land of China. The issue of migrant workers has become one of the hot spots of concern and research by all walks of life. It is imminent to include migrant workers in the legislative system of social security, but there are differences in the choice of legislative models for migrant workers’ social security. On this issue, we should advocate the “people-oriented” and social-based concepts as a guide, taking into account the actual situation of migrant workers, classification of legislative model design.
