随着新刑事诉讼法的即将正式实施,律师在刑事诉讼中的自由度明显增加,提升了刑事诉讼的公开性与透明度,增强了刑事诉讼的对抗性,但也增加了职务犯罪侦查工作的难度,给检察机关职务犯罪侦查工作的开展带来了新的挑战。为此各级反贪部门都不约而同把全面加强反贪初查工作,实现办案工作重心前移,作为应对新刑诉法、律师法挑战的重要举措来认真加以落实。
With the forthcoming formal implementation of the new Code of Criminal Procedure, the degree of freedom of lawyers in criminal proceedings has increased markedly, the openness and transparency of criminal proceedings have been enhanced and the adversarial nature of criminal proceedings has been enhanced. However, the difficulty of criminal investigation of official crimes has also increased This has brought new challenges to the prosecutorial work in carrying out the duty crime investigation work. To this end, the anti-corruption departments at all levels are invariably making efforts to fully strengthen the anti-corruption preliminary investigation and move the focus of handling cases forward as an important measure to meet the challenges of the new Criminal Procedure Law and Law Act.
