随着我国市场经济的不断发展,城市土地政策逐渐放开,国有建设用地使用权已成为城市地方政府财政收入的主要来源之一,但农村土地在法律上依然处于限制状态,农村集体经济组织、建设合同相对人、地方政府、农民这四者间的矛盾也因相关制度的不完善而无法得到解决。特别是关于集体建设用地审批问题政府占据了主导的地位,且完全超出了其应具有的地位和应发挥的作用,大大阻碍了集体建设用地的流转以及农村土地流转市场的建立。而登记制度的缺位则导致大量土地违规使用,使得农民的利益无法得到保障。因此,只有厘清四方主体之间的关系,兼顾各方利益与社会效益,才能保障集体土地的使用做到公平、合理、高效,进而保障农民的利益,推动社会经济的发展。
With the continuous development of the market economy in our country, the urban land policy has gradually been liberalized and the right to use state-owned construction land has become one of the main sources of financial revenue for urban local governments. However, the rural land is still legally restricted. The rural collective economic organizations, Contradictions among the four relative parties in the construction contract, the local government and the peasants can not be solved because of the imperfect system. In particular, the government on the issue of approval of collective construction land occupies a leading position and goes well beyond its due status and role to play. It has greatly hindered the circulation of collective construction land and the establishment of rural land transfer markets. The absence of the registration system led to a large number of illegal land use, making the interests of farmers can not be guaranteed. Therefore, only by clarifying the relationship between the four parties and balancing the interests of all parties with the social benefits can we ensure that the use of collective land is fair, reasonable and efficient so as to safeguard the interests of farmers and promote social and economic development.
