邻避风险治理已成为当前社会治理的新难题。邻避冲突的根源在于邻避设施所致的风险分配不均衡,这种不均衡反映出传统的单向度管制型行政模式的失灵。在价值多元的社会,面对多元的利益诉求,政府垄断决策、压制抗争的治理方式已呈现应对无力的困局,亟须转变治理模式,革新治理手段,以回应失衡的利益结构。协商民主理论主张不同主体之间通过平等的对话、协商和参与,达成共识,实现利益平衡,为邻避冲突治理提供一个理想图景。赋予协商过程以规范性,使平等协商成为一种制度化的程序,优化行政决策模式,完善利益平衡机制,由单维管制治理模式迈向多元协商共治模式,是缓解邻避矛盾、缓释邻避冲突的可行性路径。
Neighboring risk management has become a new problem in social governance. The root cause of the conflict avoidance is the uneven distribution of risks caused by the avoidance of facilities. This imbalance reflects the failure of the traditional one-way controlled administrative mode. In the multi-value society, in the face of multiple demands of interests, the government’s monopolistic decision-making and the suppression of the resistance have presented the dilemma of coping with weakness. It is imperative to change the mode of governance and innovate the means of governance so as to respond to the unbalanced interest structure. The theory of deliberative democracy advocates that different parties should reach an agreement through dialogue, consultation and participation on an equal footing so as to achieve the balance of interests and provide an ideal picture for avoiding any conflict. To give the consultation process a normative nature and to make equal consultation an institutionalized procedure, to optimize the administrative decision-making model and to improve the mechanism of balancing interests.
